1. Who we are, and what this covers

“Geovoya”, “we” and “us” mean the sole proprietorship that operates geovoya.com, the Geovoya desktop app and the Geovoya Cloud account service.

By using this website, the app or a Geovoya account you accept these terms. If you don’t accept them, don’t use the service. Your privacy is covered separately in our privacy policy, and money matters in our refund policy; both are part of these terms.

2. The software licence

The Geovoya desktop app is free software under the GNU General Public License, version 3 or later (GPL-3.0-or-later). Your rights to run, study, copy, modify and share the app come from that licence, and nothing in these terms takes them away. Where these terms and the GPL disagree about the app, the GPL wins.

As the GPL requires, the complete corresponding source for each released build is offered alongside it on the download page: our development repository is private, so that per-release archive is the source offer, and every published build has one. Older releases keep their archive permanently — see get the source code. Third-party components carry their own licences, listed on the open source page.

Geovoya Cloud is different. The hosted account, billing and sync service is proprietary and is not covered by the GPL. You may use it through the app and this website, but it isn’t licensed for you to copy, host or resell. Your Pro subscription pays for that service and for continued development, not for the app itself, which is free.

The feature checks inside the app are a convenience, not a lock. Because the app is GPL, anyone can build a version without them — that’s by design, and we’d rather you just paid for the service if you find it useful.

3. Acceptable use

Geovoya exists for legitimate work: developing and testing location-aware apps, QA, product demos, privacy, and travel or entertainment uses that harm nobody. When you use it, you agree to all of the following.

• Use it only on phones you own or are authorised to control. Setting someone else’s phone’s location without their knowledge and permission is not an acceptable use of this software.
• Obey the terms of the apps and services you point it at. Many forbid falsified or simulated location outright. Breaking those terms is between you and them, and can get your account there suspended or banned. We can’t help you if that happens.
• Don’t use Geovoya to deceive people. No fraud, no faking your whereabouts to mislead someone who is relying on it, no manufacturing false evidence of where you were, no impersonation, no stalking or harassment.
• Don’t use it to evade monitoring you are subject to. That includes court-ordered or bail-related location monitoring, probation or parole conditions, immigration or custody arrangements, and location conditions imposed by an employer or school you have agreed to. If someone has a legitimate right to know where you are, don’t use Geovoya to lie to them.
• Don’t break the law that applies to you, wherever you are.
• Don’t resell it as a service. You may not rent, resell, sublicense or run Geovoya Cloud for other people, share one account across an organisation to avoid paying, or offer a paid location-spoofing service built on our hosted service. The GPL gives you broad rights over the app’s code; it gives you no rights over our servers.
• Don’t attack the service — no probing, overloading, scraping or circumventing rate limits and security controls.
• One account is for one person. Don’t share your sign-in link or let others use your subscription.

You are responsible for how you use Geovoya, and for the consequences. If you use it in a way these terms forbid, we may suspend or close your account — see termination below.

4. Responsible use

Beyond the rules, here is the honest version, because a tool that moves your phone anywhere on Earth deserves some straight talk.

• Simulated location is detectable, and often against the rules. Plenty of apps look for it, and plenty of terms of service ban it. If an account matters to you, think before you point Geovoya at it. We can’t and don’t promise that any particular app will accept a simulated location, or that using one is safe for your account there.
• Other people’s trust is not yours to spend. If a friend, a family member, an employer or a court is relying on your location being real, faking it is a deception — whatever the software makes technically possible. Please don’t.
• Never rely on Geovoya where an accurate location matters for safety. Emergency calls, roadside navigation, medical or accessibility services. A simulated location can stay active after an unexpected disconnect: use Restore real location, or restart the phone, and check before you need it.
• Setting this up changes your phone. You’ll turn on Developer Mode on iPhone or USB debugging on Android, and on Android install a mock-location helper app. Understand what those do before you accept them, and turn them off when you’re done if you don’t need them.
• Builds are currently unsigned. Windows SmartScreen and macOS Gatekeeper will warn you. Check the published checksums on the download page and only continue if you trust the file.

We built Geovoya for developers, testers and people who’d rather not broadcast where they live. If that’s what you’re using it for, none of the above should ever be a problem.

5. Your account

Pro needs an account. You sign in with a link sent to your email address — there’s no password — so keeping your email account secure is what keeps your Geovoya account secure. Tell us promptly if you think someone else has access.

One account may be signed in on up to 3 computers at a time; you can sign a computer out from your account to free a slot. You must be old enough to enter a contract where you live, and at least 13.

6. Geovoya Pro, billing and renewal

Geovoya Pro is a subscription, billed monthly or yearly through Stripe. Prices are shown on the pricing page in US dollars; the final amount, including any tax that applies where you live, is confirmed on the checkout page before you pay.

• Auto-renewal. Your subscription renews automatically at the end of each billing period — every month or every year — at the then-current price, using your saved payment method, until you cancel. By subscribing, you authorise those recurring charges.
• Cancelling. You can cancel at any time from Billing →Manage billing. There’s no cancellation fee and no need to email us. Pro stays active until the end of the period you’ve already paid for, then your account moves to the free plan.
• Refunds. Your first purchase is covered by a 14-day, no-questions-asked refund, and a renewal charged in the last 48 hours is refunded on request. The details are in the refund policy.
• Failed payments. If a payment fails, Pro stays active for a short grace period (currently 3 days) while you update your payment method. After that the account moves to the free plan.
• What happens to your data. Nothing is deleted when Pro ends. Your computers can still download your cloud data for 30 days, and you can export or delete it yourself at any time.

Price changes

We may change the price of Pro. If we do, we will email you at least 30 days before the new price applies to your subscription, and it will only take effect at your next renewal — never mid-period. If you don’t want to pay the new price, cancel before that renewal and you won’t be charged it. Continuing after the notice period means you accept the new price.

7. The free plan and changes to the service

The free plan has no time limit and needs no account. We may change, add or remove features on any plan, and we may stop offering the hosted service altogether. If we discontinue Geovoya Cloud, we’ll give you reasonable notice, a chance to export your data, and a pro-rata refund of any period you’ve paid for but won’t receive. The app is GPL-3.0 and will keep working on the free plan regardless.

8. Third-party services

The app uses services we don’t run — OpenStreetMap map tiles, Photon place search and OSRM routing — and their own terms apply. They may be slow, rate-limited, unavailable or changed at any time, and we don’t guarantee them. Map data © OpenStreetMap contributors. What each one receives is set out in the privacy policy.

9. No warranty

As the GPL says: Geovoya is provided “as is”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We don’t guarantee that it works with every phone, operating system version or app, that apps on your phone will accept a simulated location, that the hosted service will be uninterrupted or error-free, or that no data will ever be lost. Some configurations have not yet been verified on physical hardware.

Some jurisdictions don’t allow excluding implied warranties, so parts of this may not apply to you.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, for lost profits, lost data or lost goodwill, for any account of yours suspended or banned by a third-party service, or for damage to a device — arising from your use of Geovoya, this website or the hosted service.

Our total liability to you for any claim is capped at the total amount you actually paid us in the 12 months before the claim arose. If you’ve paid us nothing, our liability is limited to US$0, which is what the free software cost you.

Nothing here limits liability that can’t lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Some jurisdictions don’t allow some of these exclusions, so parts may not apply to you.

11. Your responsibility to us

If someone brings a claim against us because of how you used Geovoya — breaking these terms, breaking another service’s rules, or breaking the law — you agree to cover the reasonable costs of dealing with it.

12. Suspension and termination

You can stop at any time: cancel your subscription in Billing, or delete your account outright in Security. Deleting cancels any subscription immediately, signs out your computers and erases your cloud data.

We may suspend or close an account that breaks section 3, that is used to defraud us or our payment processor, or where we’re required to by law. Where it’s reasonable and lawful to do so, we’ll tell you why and give you a chance to respond or export your data first. If we close your account for something you didn’t do, we’ll refund the unused part of your subscription; if we close it for abuse, we won’t.

You keep your GPL rights to the app whatever happens to your account — we can’t take those away, and we wouldn’t want to.

13. Trademarks

“Geovoya” and the Geovoya logo are our brand. The GPL covers the code, not the right to present a modified version as the official Geovoya — if you fork it, please give it your own name. iPhone and macOS are trademarks of Apple Inc., Android is a trademark of Google LLC, and Windows is a trademark of Microsoft Corporation. Geovoya is not affiliated with or endorsed by any of them.

14. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts of California, and we each consent to their jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, or of your right to bring a claim in your local courts where the law gives you that right.

15. Changes to these terms

We may update these terms. We’ll change the date at the top whenever we do. If a change materially reduces your rights or increases your obligations, we’ll email account holders at least 30 days before it takes effect, and continuing to use Geovoya after that means you accept it. If you don’t, cancel before the change applies. Changes never apply retroactively to a period you’ve already paid for.

16. The usual small print

If any part of these terms turns out to be unenforceable, the rest still stands. Not enforcing something once doesn’t mean we’ve given it up. You may not transfer your account or these terms to someone else without our agreement; we may transfer them if the business is sold, with notice to you. Together with the privacy and refund policies, this is the whole agreement between us about Geovoya.
